Terms of Service

By creating an account, accessing, or using 1 Click Bid (the “Service”), operated by 1 Click Bid LLC (“we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

You must be at least 18 years old and legally able to enter into a binding contract. By using the Service you represent that you meet these requirements. If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

You're responsible for safeguarding your login credentials and for any activity that happens under your account. Notify us immediately at support@1clickbid.com if you suspect unauthorized access.

We offer Free and paid plans (“Pro”, “Business”). Paid plans are billed in advance on a recurring monthly basis through Stripe. By subscribing you authorize us and Stripe to charge your payment method each billing period until you cancel.

Fees are non-refundable except where required by law. You can cancel any time from Settings → Billing; you retain access until the end of the current billing period.

We may change plan pricing with at least 30 days' notice. If you don't agree to the new pricing, cancel before the new rate takes effect.

You retain all rights to the data you upload or create through the Service — customer information, estimates, invoices, photos, voice recordings, and business information (“Your Content”). You grant us a limited license to host, store, and process Your Content solely to operate the Service and provide features you enable (such as AI estimate generation and email delivery).

You are responsible for ensuring you have the right to upload any customer contact information and that your use of the Service complies with applicable privacy and anti-spam laws (including CAN-SPAM, GDPR, CCPA, and TCPA).

The Service uses third-party AI models (including Anthropic Claude) to help generate estimates, proposal copy, and related content. AI output may be inaccurate, incomplete, or inappropriate for a given job. You are solely responsible for reviewing AI-generated content before sending it to customers or relying on it for business decisions. Nothing produced by the AI constitutes professional, legal, or pricing advice.

You agree not to:

• Use the Service for any unlawful purpose or fraudulent activity
• Send unsolicited commercial messages, spam, or content that violates anti-spam laws
• Attempt to reverse engineer, scrape, or circumvent any technical limit of the Service
• Upload malware, harmful code, or illegal content
• Share a single account across multiple users (use the Business plan instead)
• Resell, white-label, or commercially redistribute the Service without our written consent

We may suspend or terminate accounts that violate these rules.

We strive to keep the Service available but do not guarantee uninterrupted access. We may perform maintenance, upgrades, or changes that temporarily affect availability. We are not liable for any losses resulting from downtime.

The Service integrates with third-party providers (Stripe for payments, Supabase for data storage, Anthropic for AI, Resend for email, Twilio for SMS, Vercel for hosting). Your use of these features is also governed by each provider's terms and privacy policies. We are not responsible for any outages, data handling, or acts of third-party providers.

You may cancel your account at any time from Settings. We may suspend or terminate your account for violation of these Terms or for any reason with reasonable notice. On termination, your access to the Service ends; we will retain Your Content for up to 90 days to allow export, after which it may be deleted.

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, our total liability arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

You agree to indemnify and hold us harmless from any claim, loss, or expense (including attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms or any law.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Texas, and you consent to jurisdiction there.

We may update these Terms from time to time. If the change is material, we will notify you by email or in-app notice at least 30 days before it takes effect. Continued use after the effective date means you accept the updated Terms.
